BZA May 13 Minutes
The Montgomery County Board of Zoning Appeals met on Wednesday May 13, 2026. Board members present were Jason Ramsey, Steve Canfield, Seth Howell and Tom McClamroch. Staff members present were Marc Bonwell and Dan Taylor.
The meeting was called to order at 11:00 AM. Jason Ramsey made a motion to approve the April meeting minutes. The motion was seconded by Tom McClamroch. Motion carried 4-0.
ZV2603: Vault Alliance CCS LP
Marc Bonwell presented the Staff report. Preston Evans is representing Vault Alliance CCS LP for property owned by Fugate Stock Farms located in the 2000 E block of 1200 N. The request is for a Special Exception to the Industrial Classification in the Use Table of Chapter 159.
The proposed development includes the installation of one injection well and one monitoring well on a 2.7- acre parcel. The wells will be regulated by the US EPA and INDR. The monitoring well is required by IDEM for water sampling and monitoring purposes. The entrance will be from 1200 N through a shared easement with the Town of Linden. The property is currently zoned Industrial. The Staff is recommending approval of the requested Special Exception.
After a few questions from the Board, the Public Hearing was opened at 11:24 AM. There being no public input, the Public Hearing was closed at 11:24 AM.
Seth Howell made a motion to approve the Variance Request. The motion was seconded by Tom McClamroch. Motion carried 4-0.
SE2026-1: Special Exception to Industrial Zoning Districts
Marc Bonwell presented the Staff Report. The Petitioner, Preston Evans for Vault Alliance CCS LP, on property owned by Fugate Stock Farms INC. The request is for a Special Exception to Industrial Zoning District for a Carbon Capture and Sequestration Project. The Petitioner plans to drill a Class VI Injection well and a UIC Class VI Monitoring well. The property is located in 2000 E block of 1200 N.
The Staff is recommending approval of the request. Seth Howell stated that he had read all of the accompanying materials but, asked what happens if something goes wrong. Mr. Evans stated that any leaks would bring shutdown measures. Once a year an inspection would be done on the exterior of the area around the pipe. There would be a sampling of water wells in a 2-mile radius of 12-15 wells per year. Mr. Howell asked if there could be a break in the pipe in potable water layers. Mr. Evans stated the pipe has a 2X rating for pressure.
Jason Ramsey asked how many CO2 wells does Vault have. The Vaults have a second Injection well being drilled presently with seven more coming.
The Public Hearing was opened at 11:56 AM. There being no Public input the Public Hearing was closed at 11:56 AM.
After some discussion, Tom McClamroch made a motion to approve the Special Exception request. The motion was seconded by Jason Ramsey. Motion carried 3-1.
There being no further business, the meeting was adjourned.
