Your Montgomery Answer Connection (Ask MAC) has made it clear that anonymous questions aren’t favored. However, in this case, even MAC can understand a little anonymity. So without further ado, here a question that was sent to MAC about making moonshine.
Dear MAC,
I got kind of a odd question. There’s a show on called Moonshiners. They make illegal Moonshine and try to avoid getting caught by the lawman. Is it illegal to make ‘shine in Indiana? Can you make it if you don't sell it?
A Maybe Shiner
On the form folks fill out to ask a question (which you can find at www.thepaper24-7.com under the Ask MAC header), there’s a spot where it asks for name and address. Mr. Maybe Shiner had a reply that made MAC smile, “I Don’t Think So.” Well Mr. Maybe, here’s hoping you don’t do anything you might regret.
Why? Because MAC reached out to Montgomery County Sheriff Ryan Needham and here’s what the good Sheriff told us.
The answer is yes it is illegal. I have attached two IC commonly associated with this:
IC 7.1-5-4-1Possession of untaxed beverages prohibited
Sec. 1. It is a Class C misdemeanor for a person to sell, barter, give away, or possess an alcoholic beverage, knowing that all taxes due the state on it are not paid.
[Pre-1973 Recodification Citation: 7-1-1-32(6).]
IC 7.1-5-6-1Making alcoholic beverages without permit prohibited
Sec. 1. (a) It is a Class C misdemeanor for a person to knowingly own, have in the person's possession or under the person's control, or use a still or distilling apparatus for the manufacture of liquor, except as otherwise provided in this title.
(b) It is a Class C misdemeanor for a person to knowingly own, have in the person's possession or under the person's control, or use brewing or wine-making apparatus, for the manufacture for commercial purposes of beer or wine, except as otherwise provided in this title.
Hope this helps and answers the question.
Thanks,
Ryan
MAC appreciates Sheriff Needham for giving such a solid answer.
