State program to fund public defender’s office

From Mindy Byers: Data on cost to implement the State program to fund the public defender’s office.

The numbers are based off of available 2025 data:

Buser salary $183,513

Donaldson salary $137,635

Difference $45,878

Chief Pros salary: $137,635

Chief PD salary: $91,094

Difference: $46,541

Total diff in salary: $92,419

Additional FICA: $7,070

Additional INPRS: $10,351

Sub-Total of Add’l Costs: $109,840

Amount to transfer out of the Supplemental Fund, back into County General: $76,672

TOTAL of ADDITIONAL COSTS TO COUNTY GENERAL: $186,512

This, of course, does not include any other costs such as adding offices, furniture, parking spaces, etcetera.

New Business

Authorizing new part time Scanner position in the Clerk’s Office – Approving compensation classification for part time scanner position in the Clerk’s Office.

The Council tabled these requests at the last meeting in order for a job description to be developed by W.I.S., the County’s compensation consultant. The information for the job description was sent to W.I.S. Here is the response from Addie Rooker of W.I.S:

“I checked the pay plans and we prepared and classified a proposed Part-time Scanning Deputy for the Clerk’s Office at COMOT A. I don’t see the classification of COMOT A changing so you should be able to make the job description changes internally.”

According to the Compensation schedule, COMOT A is a non-exempt position with an annual compensation for 2025 of $33,081.56 for 1950 hours and a base hire hourly rate of $16.9649. Since the position is part time, the annual compensation will be less and the position will be paid per hour worked.

Authorizing Legal Intern position in the Prosecutor’s Office – Approving compensation classification for Legal Intern position in the Prosecutor’s Office.

From Jacob Moore of the Prosecutor’s Office: “The prosecutor’s office is looking to create a summer internship position for a current law school student this summer and hopefully next year as well, in anticipation of one or more deputy prosecutor positions becoming vacant January of 2027. Our office is hoping to use the money in our deferral/diversion fund and we are not going to be requesting any additional funds from the County.”

The Prosecutor’s Office worked with Addie Rooker of W.I.S. to develop the job description and compensation for the position. Here is Addie’s memo regarding the position and it’s compensation.

SUBJECT: New Position Request – Prosecutor’s Office

As requested, Waggoner, Irwin, Scheele and Associates (WIS) reviewed the following new position request for the Prosecutor’s Office.

Legal Intern

This is a new part-time position request. A job description has been created and the position will be responsible for reviewing reports from law enforcement, conducting legal research, processing files for discovery, conducting plea negotiations, and performing prosecutorial duties in court under supervision.

The incumbent reports directly to the assigned Deputy Prosecutor.

Job duties for this position include: Reviewing reports from law enforcement agencies; Reviewing files for discovery; Reviewing Defendant’s history and pending cases and drafting preliminary plea offers; Conducting legal research; Performing duties of Prosecutor in court;

Conducting research on advancements in case law; Assisting with and conducting training for law enforcement officers; Observing court proceedings, plea negotiations, and contested hearings; and Drafting documents for cases.

Job requirements for this position include: Bachelor’s degree and must have completed half of education requirements at accredited law school for a degree in law; Must be certified legal intern by Indiana Admission and Discipline Rule 2.1(a); and Must be at least 21 years of age.

We have assessed this position respective of other positions in the PAT job category and factored the position using the Factor Evaluation System (FES) job classification point-factor guide charts for PAT positions.

Recommendation:

We factored the position at 365 PAT factor points. Therefore, if the position is approved, it is recommended that the position be classified at PAT B Non-exempt and compensated at the PAT B hourly pay rate.

The base hire hourly rate for PAT B is $24.7049. Annual compensation at 1950 hours would be $48,174,56 according to the compensation schedule for PAT B.

Authorization to reduce one full time position for an attorney and hire two part time contract attorneys in the Public Defender’s Office

From Bryan Donaldson of the Public Defender’s Office: “I would like to take one of my open full-time positions and turn it into 2 part-time contract positions. There would be no benefits with the contract positions.”

If the Council authorizes the request, then a reduction of appropriation in personal services and an additional appropriation in contractual services will be required.

Resolution expressing Council’s desire to eliminate the ERPS Committee

As part of the new Compensation Plan, it was contemplated that the ERPS Committee would be replaced with a new process involving the County’s compensation consultant, W.I.S., to review requests for changes in compensation for a position. This resolution states the Council’s desire to replace the ERPS Committee with a new process. Replacing the ERPS Committee with a new process will require an amendment to the County Code. The Commissioners are responsible for approving changes to the County Code and the Council’s Resolution will be forwarded to the Commissioners for their consideration.
